Dear Mr. Callcutt,
'Upon Firm Foundations Please Build A Better Future'
With our five daughters we can not forget the night of April 2nd 2000. It was a night which would change our beautiful 'way of life' forever.
Whilst you were Chief Executive Officer of Crest Nicholson Plc, your organisation undisputedly caused a spectacular grounding and toppling 'accident' to our Houseboat 'Picton', which you will know was already our Family Home of many years at Penarth Marina in Wales UK. You will also recall that this 'accident' happened at night time, with our children tucked-up in bed and Marie Shalom was eight months pregnant. You know, (and we thank God!) that you are very fortunate, not to have been facing a charge of manslaughter.
As Chief Executive Officer, "solely responsible for enforcing Health and Safety in the Crest Group", we approached you directly, in the hope that we could mitigate the loss of that accident, and act with a common interest, common courtesy and common decency, towards the future safety of our Home.
You know from the documented record that we wanted to instruct and send down divers to inspect our boat for accident damage, and you know that subject to our commissioning a professional Y.B.D.S.A. survey report, we were advised, and wanted to lift our boat out of the water - to fix a water ingress, which developed subsequent to that accident. We had arranged our own finances, but you know that we needed your organisations' 'permission' to proceed. They never materialised.
Many, many times we wrote invitations to you, to visit us at our Home in Penarth Marina in Cardiff Bay, so that we could act with all due diligence to perform, what we considered, was our moral duty, in providing for the immediate 'safeness' of our own property and there again, to provide for minimum insurance requirements, as were the 'terms of contract', in being moored in Penarth Marina.
At all times we have acted towards you and your organisation with openness. We have respectfully drawn to your personal attention the many misrepresentations, and/or, misunderstandings to the record, held by both your good self and presented to you by former Crest Nicholson employees.
Throughout our ordeal your organisation has consistently engaged in conduct tantamount to a beauty show. This concerning the visual appearance of our Home which you personally appear to deny publicly and yet you quite readily acknowledge directly to us.
Similarly, your organisation has used every available means to besmirch and misrepresent our Family name and fine upstanding in our own, fully 'sustainable', live-aboard - 'community', despite the Court injunction that your organisation obtained, which still prevents us from visiting former neighbours at the Penarth Marina.
There was also the matter of the Penal Notice attached to that order, which provided for your organisation, for us to be locked-up in prison if we disobeyed the order granted....that we should remove our houseboat, (known to have suffered a grounding accident, known to be leaking subsequent to that accident and accordingly, due to same, unable to gain any insurance) from Crest's Penarth Marina.
As a qualified solicitor we accept that you are all too familiar with the legal processes which have enabled you and your organisation to 'win' a Court action in the United Kingdom and that you were able to do this in broad daylight, against our Family, despite our tested limited finances and whilst Ms. Shalom was in receipt of a full student loan? Furthermore, how you or your organisation would even consider that the judgments entered were ever morally obtained, will continue to be the subject of the Shalom Family Campaign for Social Justice, of which, you are aware.
We kindly acknowledge your new appointment as Chief Executive Officer of English Partnerships, the "UK Government’s national regeneration agency delivering high quality, sustainable growth in England.". Undoubtedly your life skills and career experience will be best employed by those who seek strong, decisive leadership, but we can not but question your personal integrity, and that of your organisation, regarding 'respect' for 'Family', 'Home' and 'Way of life', especially for us and our five daughters.
Whatever big or small, 'sustainable communities' you wish, or intend to build elsewhere, "where people will want to live", we believe that all successful communities will ultimately depend upon some form of 'respect' for Family and Home.
Whether immediately with Crest Nicholson Plc or with English Partnerships (and mindful of the present UK Labour Government's, 'respect campaign' already underway), we would like to see your new career firmly established upon this principle belief. We sincerely ask you to consider that upon firm foundations you would please build a better future for all of us.
Despite our clear losses to date with our 'dream' and Family Home of 14 years in ruins, and with the issue of our entire lifetime personal Family possessions still seized, (and their future uncertain after almost two years!), we kindly remind you once again. We seek only a fair and just solution in our Family Campaign for Social Justice. Presently, we can not see how we can be 'enabled' in any other way, until the 'campaign aim' is met in full.
Once again, we respectfully ask you and/or Crest Plc to meet with us to discuss a new way forward.
